Terms and Conditions
Please read our terms and conditions carefully as they govern the use of our services between you and FarmersTable LLC, doing business as (d.b.a.) FarmTab.
Definitions:
- Merchant, refers to farmers, producers, and growers of items listed on the website.
- Customer, refers to anyone purchasing items listed on the website.
- Order, refers to requests made to FarmTab. Order requests are fulfilled by payment by means such as credit card, Stripe or other electronic form.
- Platform, refers to the website, the technology or the services offed by the Company.
- Company, refers to FarmersTable LLC, d.b.a. FarmTab, or FarmersTable LLC, or FarmTab.
- User, anyone using the Platform or Company services.
- User Content, text, video, images, or other media uploaded by a User.
- Account, registered User profile.
1. Using the Platform:
Merchants are independent of the FarmTab Platform, we do not control the quality of the agricultural commodities, produce or other items sold by Merchants, nor do we control the products offered by Merchants, we simply provide a means as to which a customer can select items of their choice through our Platform and Order the items to purchase from the Merchant.
Merchants are allowed to use the Platform to sell the produce and other agricultural commodities that they already offer through the Platform. Merchants receive payment once an order is placed by a Customer. A completed order means when a Customer, after purchasing items from a Merchant with payment through the Platform, has their order delivered successfully or is picked up in-person by the Customer.
FarmTab does not sell the items listed by our Merchants nor is FarmTab in the business of selling agricultural commodities. We are in the business of connecting Merchants to Customers through our online Platform.
A transaction made on the Platform is between the Customer and the Merchant. FarmTab is not a retail food establishment. FarmTab will pay the Merchant on the Customers behalf on all Orders placed on the Platform.
FarmTab retains the right to cancel any Orders placed on our platform.
2. Delivery:
FarmTab is not in the business of delivery. Through our Platform Customers can place an Order for items offered by Merchants. At times our Platform connects your Order to be fulfilled by a third-party delivery vendor. The fee for delivery is based on the method selected at checkout for each individual Order. Once an Order is placed on our Platform the fee processed for delivery is non-refundable, unless otherwise mentioned.
The Company retains the right to increase the price for delivery at any point during your use of the Platform.
The Order lead-time may vary from each Merchant and for each Order. Depending on the type of order, a customer may be able review when the delivery will arrive before they place an order at the checkout page. An arrival time for delivery will not display at checkout if a subscription item has been purchased or the shipping method for your Order is for Local Pickup, this information will be handled between the Customer and Merchant for each individual Order.
Orders placed for delivery though our third-party vendor can be tracked via SMS text messages after a driver has been dispatched. All standard text messaging rates apply.
At any point we retain the right to cancel your delivery order. Due to the nature of subscription orders and merchants providing different locations for their deliveries to be picked up by a third-party driver, it is the Merchant's responsibility to provide Customers with an explanation for any changes between the time an order has been placed and any recurring deliveries associated with their order.
Local pickup is also an option for Orders placed on our Platform from Merchants. It is the customers sole discretion to work with the Merchant and reach out the Merchant to choose an agreeable time when the Customer can go to the Merchants location and pickup their Order.
3. Orders and Conditions:
We do not check the quality of the items sold by Merchants. Merchants are responsible to ensure the quality of the items sold from their location. All sales from Merchants that require licensure, certification and/or inspection from a food regulator are between the Customer and Merchant.
Produce sold by Merchants through our Platform is meant for direct-to-consumer use, and is not intended for wholesale or food-service use.
Any issues or complaints from the Customer about the items received must be brought to the attention of the Merchant. It is their sole responsibility to resolve these issues.
The Company cannot guarantee that the items sold on our website will be available at every Merchant location. When there is any item out of stock at a chosen Merchant location, it is the Merchant’s responsibility to choose a replacement item that is of equal or greater value than the original Order made by the Customer. The Customer fully understands that their Order may not be fulfilled exactly as the Order is placed due to the nature of the Merchants business practice and accepts that replacement items may be a part or complete of their fulfilled Order.
Merchants cannot substitute out-of-stock Orders with meat, fish, eggs, dairy, any animal bi-product, non-edible items, baked goods, drinks, or frozen items without notifying the customer. The Platform offers direct messaging to the Customer about orders placed and can be used to discuss any items that need to be replaced and which items to replace them with. In addition merchants cannot substitute out-of-stock Orders with any illegal or age restricted items such as, but not limited to: alcohol, tobacco, hemp, marijuana, and any illegal substances. Merchants will be promptly reported to the authorities if any illegal substances or restricted items were sold to a Customer or replaced for another item for the customers Order.
It is the Customers responsibility to properly fill out the address of their location when placing an Order for delivery from our third-party vendor. This would be the location that the delivery driver will arrive at with the items that were Ordered on the Platform.
Once an Order is received it is the Customers responsibility to retrieve the items that were delivered. It is the Customers responsibility to provide a safe location for the delivery of items. It is the Customers responsibility to properly store these items so they do not degrade. FarmTab does not claim responsibility for any stolen items, degraded items, or the product's condition after successful delivery to the Customers location.
4. Service fees, processing fees, and tax fees:
FarmTab may charge a service fee for Orders placed on this Platform. Orders placed for delivery through our third-party fulfillment partners have their own set rates that vary from each individual delivery. These fees may be displayed at checkout prior to the Customer placing their Order. It is the Customers responsibility to pay for delivery fees, unless otherwise mentioned.
Payments to Merchants are handled via a third-party electronic payment processor such as Stripe. These third-party processors have their own fees respectively, it the Merchant’s responsibility to pay for these processor fees.
We make it clear which items sold on our Platform are exempt from taxes. We charge tax fees on our products and services when applicable by law.
5. Refunds and returns:
After a payment from an Order has been received we will payout the amount received by FarmTab to the Merchant respectively, excluding any fees made to the payment processor. The Merchant is responsible to pay all payment processing fees, these payment processing fees are non-refundable. The fees paid for delivery are non-refundable. We process payments on all Orders within 24 hours of purchase. We may pay the Merchant for the Customer's Order prior to retrieval of the items from the Merchants location, unless otherwise mentioned. All sales are final once placed on the Platform. The Customer must reach out to the Merchant for any partial refund for their Order.
If there are items that were not received Customers should bring this to the attention of the Merchant. It is the Merchant’s responsibility to work with the Customer during a refund dispute. Our support team can help further expedite partial refunds within 24 hours of the purchase. Merchants, please contact our support team via the support page.
If a refund is issued, FarmTab may refund the Customer on the Merchants behalf. We may then collect the refunded amount owed to FarmTab from the Merchant.
After the 24 hour period there will be no issuable refunds from FarmTab. We along with our Merchants are not capable of receiving returns on items sold through the Platform.
6. User Content
To use certain parts of the Platform, you may need to register for an account. During registration and whenever you use the Platform, ensure that the information you provide is accurate, current, and complete. You are the sole authorized user of any account you create. You are fully responsible for all activities under your account. You may not give access to your account to others, you may not assign or transfer your account to any other person or entity either. It’s your responsibility to monitor your account and prevent unauthorized use, especially by minors. If you suspect unauthorized access, promptly notify the Company.
FarmTab offers interactive features within its Platform, allowing users to contribute User Content. By submitting User Content, you assert ownership or the right to share it. You represent and warrant that any User Content you submit, post, or transmit through the Platform complies with these terms. You also confirm that any User Content you submit, post, or transmit through the Platform, either directly or on your behalf, does not:
- (i) infringe upon any third-party rights, including copyright, trademark, patent, trade secret, privacy, or other intellectual property or proprietary rights.
- (ii) include false, misleading, defamatory, offensive, or pornographic material. Additionally, it should not vilify or incite hatred based on race, religion, ethnicity, gender, age, sexual orientation, or any physical or mental disability.
- (iii) include material that is illegal or pertains to unlawful behavior.
- (iv) include material that poses a privacy or security risk to any individual, such as soliciting personal information or containing confidential, sensitive, or personally identifiable details. Additionally, it must not solicit money from anyone.
- (v) provide financial, legal, medical or professional advice.
- (vi) harm, abuse, harass, or offend others.
- (vii) reflect negatively on the Company, or FarmersTable LLC, d.b.a FarmTab’s name.
- (viii) tamper with our website technology, make unauthorized changes or violate any state or federal law.
- (ix) violate our terms and conditions.
By submitting User Content, you grant FarmTab (including its service providers) an everlasting, irrevocable, transferable, fully paid, royalty-free, non-exclusive, global, sublicensable right and license to utilize, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute, and otherwise employ the User Content for FarmTab's business purposes. Additionally, you authorize FarmTab to attribute User Content to you using your username, first name and last initial, profile photo (if available), and other User profile information, without requiring your notification or approval.
You also acknowledge that FarmTab is not obligated to attribute it to you in connection with any use. Additionally, you agree that this license allows other users to access and use your content within the Platform as permitted by its functionality.
FarmTab has the discretion to remove or disable access to any User content, suspend or terminate accounts, or seek other remedies available under law if users post content violating this agreement or any other guidelines we may publish or that we consider is not suitable for our Platform or do not want on our Platform for any reason.
By using the Platform, you acknowledge that FarmTab has the discretion to monitor, alter, cancel orders, place orders on a Users behalf, delete, or choose not to publish your User content without any obligation to do so.
FarmTab reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (i) comply with applicable laws, regulations, legal processes, or governmental requests, and (ii) enforce this Agreement, including investigating potential violations.
7. Intellectual property
FarmTab holds exclusive rights, including intellectual property rights, related to the Platform. This Agreement does not constitute a sale, and it does not transfer any ownership rights or related intellectual property rights to you.
No permission or license is granted for the use of the FarmTab brand name in conjunction with this agreement.
You are obligated not to alter, remove, or obscure any copyright, trademark, service mark, or other proprietary notices that are part of or accompany the Company or Platform.
8. Modifications to this agreement
The Company retains the right to alter the terms and conditions of this agreement or its policies related to the Platform at any time. Such modifications take effect upon posting an updated version of this agreement, which can be found at https://farmtab.com/terms-and-conditions.
It is advisable, and at the discretion of the User, to regularly review this agreement as your continued use of the Platform and services following any changes indicates your acceptance of those modifications.
If you disagree with this agreement or any of its amendments, promptly discontinue using the FarmTab Platform.
